If you appeal, your application will be reconsidered by a case officer. The decision may be reversed if new information emerges or it becomes apparent that the initial decision was incorrect, and the application may be granted. If the case officer does not reverse the decision, your case is forwarded for new processing – either to the UDI (if the case was processed by a foreign service mission) or to the Immigration Appeals Board (UNE) (if the case was processed by the UDI). The appeal body’s decision is final. In other words, you cannot appeal a rejection of an appeal.

 

The deadline for appealing is three weeks from the date on which you or your lawyer received the decision, or from when you should have become aware of the decision.
If you submit an appeal before three weeks have elapsed, but wish to send more information later, you will be given a deadline of two weeks to submit the rest of the information and documentation. Once the two weeks have elapsed, the UDI can consider the appeal regardless of whether or not more information has been received.

 

You must appeal in writing. This means that you must submit a letter stating which decision you are appealing. You should document your assertions and any new information and sign the letter. You, or the person who represents your case and whom you have authorised, must submit the appeal to the UDI or the foreign service mission by the deadline.

You do not pay a fee for appeals.

 

In connection with an appeal against a decision regarding a residence permit while you are staying in Norway, you can also ask for deferred implementation of the decision. This means that you will not be sent out of the country before the Immigration Appeals Board has processed your appeal. The Directorate of Immigration processes applications for deferred implementation, and you cannot appeal its decision.

 

Visa
If a foreign service mission has rejected your application and does not reverse the decision following an appeal, your appeal is processed by the UDI. If the UDI has rejected your application and does not reverse the decision following an appeal, your appeal is processed by the Immigration Appeals Board.

 
Residence cases
In residence cases, you can submit your appeal to the UDI, which will then reconsider your application. We can reverse the decision and grant your application or uphold the decision and forward the case to the Immigration Appeals Board for new processing.

Asylum cases
If you appeal a decision in an asylum case, the appeal is first considered by the UDI and then by the Immigration Appeals Board if the UDI does not reverse its decision and grant the application.
