Can I stay in Norway while UDI considers my appeal?

If implementation of the administrative decision is deferred, you can remain in Norway while waiting for the outcome of your appeal.

Certain people have the right to stay in Norway during the appeal process (deferred implementation of an administrative decision) while others can ask UDI for deferment. Please see your decision letter for more information about deferred implementation of an administrative decision as well as the deadline for requesting deferment.

  • If you are granted deferment of implementation, you can stay in Norway until a final decision on your appeal has been reached.
  • If you are not granted deferment of implementation, you will have to leave Norway by the deadline you were given.

The rules concerning deferred implementation are set out in the Immigration Act, Section 90 (external website) and in the Public Administration Act, Section 42 (external website).
